Abstract

Posting of workers is a particularly representative area of tension between the economic and social dimensions of EU law. Despite the evolution of the regime towards greater accountability of Member States (MSs) for the enforcement of the rules established for posting, the cause (albeit on a smaller scale than in the recent past) that encourages discriminatory and fraudulent practices affecting posted workers remains: the existence of significant differences in labour costs between the MSs, in particular those related to social security charges and working conditions fixed at the level of collective agreements that lack general effectiveness.
